How the Asylum Process Works

There are two ways to obtain asylum: affirmatively or defensively. Migrants who apply for asylum affirmatively submit a form to the U.S. Citizenship Services within one year of arriving in the U.S. Those who apply defensibly do so after they’ve been arrested and placed in expedited removal proceedings. In both cases, migrants can be interviewed by a specialized U.S. office that determines their status in returning to their home country. Oftentimes, migrants pass this initial screening. However, it is becoming increasingly difficult to pass the Credible Fear Interview (CFI). The chances of winning asylum in El Paso, Texas or in Chaparral, New Mexico is roughly less than 10%. Therefore, if you have this kind of case it is absolutely crucial that you hire an attorney with asylum law experience that has a successful track record. The Winterberg Law Firm is ready to help.

  • Determine the best timing and procedures for successful results
  • Ensure that you are eligible for asylum as a matter of law
  • Advise you of possible difficulties and how to strategize considering them
  • Highlight facts in the most favorable light to the grant of asylum

What You Need to Know About Asylum in the US

While asylum seekers and refugees are different, they share the experience of having to escape their home countries, often without warning, and embark on a difficult and dangerous search for safety. Hardship and trauma often follow asylum seekers, especially when asylum applications and cases are difficult to enforce. Unfortunately, asylum laws change from day to the next.  Depending on the current political climate, asylum laws become more challenging and burdensome. By working with an asylum lawyer that keeps abreast of the ongoing changes in the law, your asylum process can be made much smoother.

Federal Asylum Laws

U.S. federal law states that one may be granted asylum if they are a refuge. The law defines a refugee as any person who is outside any country of such person’s nationality who is unwilling or unable to return due to well-founded fear of persecution.  Meeting this criterion is essential if applicants want to apply, and more so, wish to receive asylum status in the United States. Reviewing the reason why you may have left your country with an experienced immigration attorney at the Winterberg Law Firm, P.C. can help you understand the complexities of asylum to see if you qualify.

Your Asylum Rights

Once you are granted asylum, you are legally allowed to remain in the United States indefinitely unless the status is revoked. Additionally, you are authorized to work while residing in the country. For applications, you may be eligible to apply for employment authorization if your application was received by the USCIS and it has been pending for 150 days. For those facing removal proceedings, if you file your application with the immigration judge or court and it has been pending for 180 days, you may apply for employment authorization.

Requirements for Applying for Asylum

In order to apply for asylum, applicants must establish that they fear persecution from the government in their home country. More specifically, applicants must prove that they would be persecuted on account of at least one of the five protected grounds: race, religion, nationality, political opinion, or particular social group.

Submitting a complete asylum application consists of:

  • Immigration Form I-589
  • A declaration
  • Corroborating documents (medical reports, police reports, letters from witnesses)
  • Country conditions documentation (human rights reports, newspaper articles)
